 If, as you have indicated, you don’t trust Prosper to detect fraud when it exists or to remunerate you when we find it, then you should reconsider whether you want to lend on Prosper. I did; withdrawing since Black Friday, March 30, 2007--with one exception.

A very spirited and intelligent letter.
It affirmed what I had believed, that to establish trademark infringement, someone must have the intention of making a profit. The letter from Prosper was bluster and bravado, designed to intimidate. This lawyer dealt with that aspect of things, too. Bravo!
If Prosper has any sense, they'll drop such ludicrous attempts to monitor the free speech of others on other websites. They can censor people in their own forum to their hearts' content; but they would do well to know the limits of both decency and the law.

Sweet, wonderfully sweet. And precisely what Prosper deserves for such deeply unprincipled and sleazy behavior.
My favorite line is: "Although your client may believe that it can invoke trademark laws to block public access to criticism while allowing access to praist, this belief is sorely mistaken."
I like the entire letter, though.
And my donation of $50 to the Public Citizen Litigation Group, earmarked for defense of prosperreport.com, will go out in Wednesday's mail. Nice going, 112233

Prosper is going to have to stop promoting third party sites (and stop employing owners of third party sites) before Prosper's complaints can be taken seriously at all. Prosper's demands are transparent jackassery.

Also, is prosperreport.com itself Googled? If so, the letter should be posted in text form there too.
