In form 10-Q to the SEC, Prosper reported: “As of June 30, 2009, we had entered into 13 consent order agreements and have paid an aggregate of $123,878 in penalties.” Unnamed in the disclosure were Alabama, Maine, Michigan, Missouri, Montana, North Dakota, Ohio, Oregon, Washington, and four other early participants who remain unknown to us (acted in May or June — NASAA's template for the process wasn't finalized until April 21).
Since June we saw Colorado and Connecticut order sanctions of $19,900 and $12,602 respectively. Therefore, Prosper's total penalty (as we know it) stands at $156,380, a sum far short of the potential $1 million involved.
