for what it's worth...  one of my BK's (#319614) just flipped from "past due" to "charged-off" within the last few days.  now it shows a BK discharge date of 6/17/10 and a "charge-off" date of 9/5/10.  no explanation as to why the status (& BK date) wasn't changed back in September (last payment was 4/7/10).

A significant payment is processing. So, Prosper has made the lump payment on this loan that it said it would make.

How many notes are on the loan?  Are they paying against all notes or only yours?

As far as I know, they're only paying this bk, but I believe they're paying all lenders.

Some poor guy over there actually investigated the second time I asked about this bk, and found that Prosper hadn't timely filed its proof of claim.  Because the borrower was otherwise paying off 100% of her debt through her ch 13, Prosper did the right thing and decided to pay this one off as if it had timely filed a proof of claim.

I encourage all borrowers with undischarged bks to ask Prosper for a status report for lots of reasons.  This is one.  Prosper could be receiving payments and not applying them to loans.  Or, the borrowers could have dismissed their bks, or had them dismissed.  Since the only updates I have ever seen on my bks is when they are discharged, I don't think that Prosper is handling them appropriately.

I will be emailing Prosper for updates on several other bankruptcies in the near future.

Dear [Senator],

We appologize for not responding sooner to your inquiry. Although we would have
liked to provide an update instead of a form response we do want to acknowledge your
request was received.

Prosper will research these loans to ensure the bankruptcies were handled correctly
and corresponding filings were made in the required timeframe. Please allow some
time for Prosper to complete the investigation. As soon as more information is
available we will contact you with the findings. Thank you for using Prosper.

For future reference, your Prosper support case number is 00451685.

Sincerely,
Prosper Customer Support

Per the following link, Prosper has apparently missed filing at the appropriate time
the correct paperwork for a borrower filing Chapter 13 bankruptcy.

http://www.prospers.org/forum/bankruptcy_update-t22912.0.html

On loan #383 I was a lender and the status states collection attempts were suspended
because of Chapter 13 bankruptcy but no followup (or payment) in a year. Please
review it and let me know the status of Prosper filing as a creditor.

Thank you.

Nothing but silence from Prosper.  How long is reasonable for Prosper to finish their investigation?

I think it's more than enough time for Prosper to finish its "investigation" of the few bks that you have.

While Prosper *should* investigate all of its bks, a smart business would start with people who are complaining.

Can I get a status for case #00451685?  It's been over a month since you said you needed some time for research.  I, however, fear I've been forgotten.

No, but you can probably use Nonattender as a back-channel.

BTW- I recently received a recovery payment on loan 1408- Ch 13 BK in August 2007.  Payment was about 10% of charged off balance.  (For the really old timers- this was "Octoberfest27".  No other payments since filing in Aug 07.

Several other BK13s have been making small payments for a long time, such as loan 8902

It has now been over 7 weeks since I sent my request for information, and 6 weeks since Prosper last gave an update. An update which merely said (paraphrased) "We'll look into it."

9 days since I asked for an update - silence.

This note on their Messages page might clear the problem:

They were too busy creating a blog post about how they're better than Lending Club to answer questions from lowly lenders.
