I was thinking about this today. What recourse do class members have if they do not receive their settlement money or if  the company decides not to pay 1 or more specific people for some arbitrary (and wrong) reason (usually there are terms that qualify you). Prosper doesn't necessarily fit this description yet.  I'm just asking in general.

I don't remember if the settlement agreement contained a dispute resolution process.  If so, that is the recourse.  If not, they could file a motion with the judge seeking to hold Prosper in contempt for violating the settlement.

No I have not gotten my second check yet. I just assumed it would be a "large" (sic) as the first - LOL

It has been just over a year since our first payments came in the mail, but as far as I am aware, nobody (including me) has seen any sign of the 2nd payment coming in.

Contacted borrower, and he promises to pay.

Translation: I emailed the folks doing the distribution, told them they were late, and got a reply which said that they would mail checks by the end of August.

Ok, there is no excuse.  They sent checks last year, so now to send the 2nd installment, all they have to do is push a button and print the labels.  I suggest everybody email or call and ask for our checks.
