akmicrokid2003 posted another comment on the article:

I want to apologize for prior comments which were in fact somewhat off-topic.

The only comment I have on this accusation of Prosper's legal misrepresentation is that I want Prosper to defend its statements.

Could we all perhaps make a coordinated effort to have these particular concerns addressed by some representative of Prosper.com before muddying their name in front of such a wide audience of readers?

I for one would be happy to call them - or email them - this article and its lengthy comment stream. They need to get in on this and clear the air.

I responded with:

Quote from: Xenon481
@akmicrokid2003: Prosper has been notified about this in a number of ways including unanswered e-mails to support and numerous posts about it on their own official forums (all of which are read by a Prosper employee). It should be noted that just about the only posts that Prosper is allowing on its forums are the ones that say that these statements (Filing vs LRA) are not contradictory. Because all of these posts must go through a Prosper employee, I feel that this could be interpreted as an official Prosper position on the issue.

Fred93 has invested an incredible $258,607.19 but not $800,000 as the author CHUCK SALETTA stated. Futhermore in Chuck's follow up post he states the facts in his article were checked by 2 other staff members. Well, if they failed to check this one fact why would we as intelligent readers believe they checked any of the facts in the article?

1. Prosper's filing in the BK case was contrary to its contract w/lenders (Source: Prosper docs., BK court filing)

So what? they were trying to keep the client from filing bankruptcy on your loan!

So, it is perfectly ok to lie to a court just to get what you want.

Do you suppose Prosper would rather answer questions from enforcement@sec.gov? The SEC may find it a novel concept to say one thing in the Lender's Agreement and S-1 filing, but state something else before a judge.

I say we wait until the end of Monday for a response from prosper about this issue & their 'ID Theft Guarantee'.  If we don't get a decent answer, I say let's follow up with the above stated agencies and see if they can do a better job of getting answers since prosper seems to be ignoring us (or sending marketing lapdogs to fool.com to try & blow smoke up everyone's rear end to confuse the issue).

Note to Prosper: The Marketing team can only do so much with what they are provided.  You can't seriously expect them to keep on slapping a fresh coat of paint on this run down shack & sell it as a premium product.  Time to start listening to your customers, address their concerns, work out some deals that everyone can live with & rebuild some mutual respect.  Remember the good old days when everyone thought they were working together on the same side?  There is your marketing gold, word of mouth & long term stability.  Do you want to keep the lights on or run this shack into the ground?  Fresh management.  Now is your chance.

This couple was gung ho on Prosper and even blogged they were going to put $70K into it at one time. http://www.dinksfinance.com/2006/09/putting-70000-into-prospercom.html

Most people here were gung ho at first.  It's a learning curve between the marketing hype, reality & trying to figure out what services prosper really does provide & which services they make you think they are providing.

Classic comment from Urbi to a poster who said they were leaving:

"Once again, we note that your threats are hollow and you come across like a sad, lonely blowhard.

I doubt anyone here gives a shit about you.  We pretty much all know that you are a vile and unethical parasite of a human being with an abnormal craving for attention."

I'm curious to see if there is ANY reaction (ok, any semi-public reaction) to this article by the Prosper folk.

Continued personal attacks rather than disputing the facts...

Besides, given the wreckage that Trump has made of the GOP, plus demographic trends, if the Democrats can put into place strong protections of the right to vote to prevent (and roll back) GOP voter disenfranchisement schemes, there is a high probability the GOP won't control the House, Senate and White House again for decades (if ever).  Hell, the GOP has only won the popular vote for President ONCE in the last SEVEN elections, so clearly the voters aren't buying what they're selling.
