PMI Selected enforcement of TOS
« on: January 11, 2008, 11:51:06 am »

More than 2700 Member pages contain URLs pointing to external websites; none of which are prospers.org
I ran the resultant list through the "uniq" filter & ended up with just over 2000 different sites.
As we already knew PMI has a SERIOUS vendetta against this site.
I guess the truth hurts & are trying to pretend that all is OK on Planet PMI.

Exactly.  If Prosper wanted to go on a vendetta against .org, it should have simply announced that no links or mentions of .org would be permitted, rather than lying and saying that the .org links were removed because Prosper's TOS prohibits all external links (or the even more egregious -- and defamatory -- lies that .org was essentially a phishing operation).  Unfortunately, Prosper doesn't care much about (or for) the truth.

Right. I even made it an issue with my Prosper Lender Representative.
Quote from: me
Bryan, this is Mark12547 ([PII deleted]).

My Prosper home page description just got deleted, apparently contrary to the agreement I have with Prosper.

>From the Lender Registration Agreement, which I "signed" on May 6, 2006, is this paragraph:

Quote
14. Home Page Display and Content. You may, but are not required to, maintain a "lender's home page" on the lender section of the Prosper website, where you can post photos, content, logos or links to websites. If you elect to do so, you authorize Prosper to display on the Prosper website all such material you provide to us. Any material you display on your home page site must conform to the Prosper Terms and Conditions, as amended from time to time, and must not (i) infringe on any third party's copyright, patent, trademark, trade secret or other proprietary rights or right of publicity or privacy; (ii) violate any applicable law, statute, ordinance or regulation; (iii) be defamatory or libelous; (iv) be lewd, hateful, violent, pornographic or obscene; (v) violate any laws regarding unfair competition, anti-discrimination or false advertising; (vi) promote violence or contain hate speech; (vii) contain viruses, trojan horses, worms, time bombs, cancelbots or other similar harmful or deleterious programming routines.

The page contained links to websites that deal with investments and websites that deal with lending specifically on Prosper. In fact, the only reason I transfered in almost $4,000 to Prosper recently was because of someone who was active at one of those sites that said she was going to list and we interacted during the preparation time for her listing. None of the links violated any of the forbidden activities listed above. The only thing the links violated was reference to third-party sites that have been imposed upon the lenders ex post facto. I now regret having transferred in the funds and bidding, not because of the listing I bid on, but because I don't trust Prosper Marketplace since they seem quite able to violate their own legal agreements.

It appears to me that Prosper Marketplace, Inc., is manic on suppressing any reference to any sites outside of them, which is just the opposite of their position a year ago, suppressing any interaction between members (as witnessed by the replacement of forums with the ultra-moderated draconian approach of letting only a tenth or less of the messages become public, and then not allowing any communications between borrowers and lenders), and suppressing anything that could be construed as casting a negative light on Prosper. By suppressing any valid criticisms, criticisms will still be published, but in areas where it may be more difficult to respond, such as the recent threads on a New York Times blog: http://freakonomics.blogs.nytimes.com/2007/11/28/adopt-and-prosper/

Well, since Prosper feels fit to violate the Lender Agreement I had agreed to, I feel fit to go back to withdrawing all my funds as quickly as I can. Next time I meet a borrower on one of the sites that I can no longer name on Prosper.com, and I feel like that borrower would be a good risk, I'll just have to decline due to Prosper's violation of its agreements with me, Prosper's continued false advertisements, Prosper's over-handed censorship, Prosper's new efforts to stamp out any reference to any web sites that might present a more balanced picture about Prosper than what Prosper's so-called forums allow.

Thank you for your call and email. Too bad Prosper Marketplace, Inc., is being so contrary to what they were a year ago and is being very hostile to lenders.

Sincerely,

[PII deleted]

I haven't heard from my Prosper Lender Representative since sending the above email.

that's no surprise. it's their site though. they can play these games if they want to.
True enough.

This was my email to support after I was banned for a subversive profile:

Quote
I'm sorry to hear that Prosper is no longer interested in retaining me as a customer.

As part of your suspension process, you have changed my Member Summary page to read:
"This member has not added a description."

This statement is factually incorrect. I have added a description several times. The description has been deleted by Prosper, which is obviously very different from not having added a description.

I am requesting that you modify the verbiage on my Member Summary page to accurately reflect the truth, or that you no longer make this page publicly available on the internet.

Thank you in advance for correcting this oversight,
[PII]

No response. No change to the profile. No surprise.
It bugs me that they are posting a lie on my member page. I never authorized Prosper to lie on my behalf. Maybe I should go report my profile? Wonder if the banned can do that?

I believe you can, because I have reported a listing since being banned (by my 2 month late $24K B borrower with 14% DTI who didn't bother making even his very first payment).  Obviously fraud, but doubtful Prosper will do crap unless it becomes obvious it was ID-theft.

Even if you report your profile, however, Prosper will still just ignore you.

I've gotten used to that, it won't bother me.

ETA: But at least by posting here, I can be certain that someone from PMI will read it. Can't say the same about emails to support.
