If i knew that Prosper would only sue borrowers in California, then i would have only bid on loans in California.

I have a Georgia borrower that got 24k without making a payment that needs suing.

Yep -- a 0/0/0 14% DTI B borrower who stole $24K from lenders (including a snickers from me).  Unless he was kidnapped after getting the money, used it for ransom, but they killed him anyway, I can't see any way that this loan wasn't fraud.

It has to be fraud. It was either ID theft or borrower fraud.

And why the hell have they not made an effort to use legal means (civil or criminal) to make a recovery.
Dammit LoanChimp are you so immune to all the BS lenders have gone through.

Well, Prosper did sue Victoria Crawford for taking out 10 loans under false names.  Oh wait, that was to recoup Prosper's OWN money, after having to repurchase those loans from lenders under its ID-theft guarantee (after forum detectives discovered and publicized the fraud, using the city information that Prosper shortly thereafter removed from listings).

I can't remember if I've said it here already or not (the mind is a terrible thing to waste) but IMO, the simple fact that P-----r didn't "reach out" in the 3 weeks after they received this letter signals to me that they have absolutely zero intention of dealing with this on a cordial basis. This was a letter with questions and asking for basic answers. It was completely ignored. Every bullet point has been brought to their attention ad nauseum over the last 1+ year so even if the answers were as easy as LoanChimp seems to think they are, they could have at least responded with what he wrote.

They didn't. They didn't even take the 10 or so minutes it took LoanChimp to answer to do the same.

We are lenders. We are the gum at the bottom of their shoe that they can't seem to scrape off.

They've really left us no choice but to take a legal route to get answers to very simple basic questions. This reinforces to me the horrible way this company is run.

AND AGAIN, if you don't want to be a party to this, you will have a chance to opt out!!!

I doubt anyone here gives a shit about you.  We pretty much all know that you are a vile and unethical parasite of a human being with an abnormal craving for attention."

Prosper responded to our attorney today.

Prosper, I know you read here.  I will be happy to share the contents of the letter publicly if authorized to do so.  (A PM from RateLadder is sufficient.)

Isn't it your letter now?  Is there a legal reason you need -------'s permission?   (I sincerely want to know.)

MHS, from a purely legal perspective, there's no reason that I couldn't post the letter.  However, I didn't write it and it wasn't sent to me, so I don't feel comfortable posting it without Prosper's permission.

Since there's been so much interest in this topic, I thought in fairness to Prosper, I'd post that it did respond and give it the option of permitting us to post the response.

Then we don't publish its letter....  I can't imagine Prosper WOULDN'T want its letter shared, since there's so much interest here, but IMO, that's up to Prosper....

That just seems wrong to me.  To bring this whole issue to light, hire your own lawyer (which I do realize you all paid for, not me), raise awareness and then to back off?  Am I alone in this feeling which just doesn't sit right?

I am sure they will be quite proud to show off their thorough and thoughtful response to a serious inquiry.

Cushie.... I thought you were talking about the response our lawyer got today, which was not substantive.

Sorry!

Any and all SUBSTANTIVE information will be shared.
