Prosper is only suing California deadbeats

Had I known that PMI would only litigate in California,then I would have only bid on borrowers in California.

That thought occurred to me.  But with California ranked 11th (not counting state "AA") in terms of highest percentage delinquent (20% - yes, 1 in 5), I figure if I'm gonna filter by state, then I'm better off sticking to, say, the single-digit percentage late states even if Prosper doesn't litigate there.

State rankings of lates are misleading due to former rate caps & loan amount caps.

The big question remains, Are they SERVING?

Just checked Riverside.

Case against Deborah Shannon dismissed without prejudice on June 9, 2008 (Case No. TEC 086135)

Trisha Ramirez was served in APRIL and proof of service filed in JUNE (Case No. BAC010612).  No responsive pleading filed.  No request for default filed.

No evidence of service on Jodi Collins (Case No. HEC029337)

No evidence of service on Sandra Hastings (Case No. TEC 086138)

Case against Jerald Cline dismissed on July 7, 2007 without prejudice (Case No. RIC494584)

Jamie Mack subserved on July 3, 2008 (RIC498016)

Damien Ramirez was subserved on June 10, 2008.  (BAC 010615).  No responsive pleading filed.  No request for default filed.

Prosper is NOT taking care of business here.

I wonder why the dismissals without prejudice?  WITHOUT prejudice generally means no money paid.

Are they even suing all the people in CA??

Had I known they were only suing in CA, I would only have bid on CA loans. If I'd known they were only suing a portion of CA borrowers, I wouldn't have bid at all. They must look at us like total sheep.

question: could you tell in these records if prosper dropped a case? would the dismissed w/o prejudice apply or is there some other legalese that shows up?

How is it possible to find out more about these cases? Are there minutes kept for such cases?

I thought in the one case Prosper said they didn't make the loan, that they were agents for the borrower, and that loan came from lenders.

I don't understand.
