Author Topic: Anyone on Ashley Gaerke's loan (possibly in the name of Oakland Gaerke)?  (Read 554068 times)

Glad I'm providing entertainment to you, NA.  But you have to take me off ignore to read my responses and to search for my old posts.  Isn't that too much work?

Based on the information I have (including the federal filings and a lengthy conversation with the husband's attorney), I'm confident that this was one of many identity theft loans the wife took out.  I explained to the attorney what Prosper is, and sent him the LRA.  He, in turn, told me that Prosper was the only debt that had not been settled, and IIRC,the others accepted the ID theft affidavit. 

I should check back on PACER and see if he's filed the LRA, or if something shows as having happened with the Prosper debt.  I'll post if there's anything.

Quoted for posterity - or maybe, preposterity.  (Is that a word?  It should be.  Preposterous needs a noun form.)

Sorry to butt in on the fun but there appears to be a payment on the way on this one.

Here's the equation:

12 pages of bad analysis of the court filings between a husband and wife going through a divorce and a bankruptcy
plus
26 claims that, surprise, "those debts aren't mine, they're the result of identity theft - my (circle one) husband/wife stole my identity!"
plus
2 erstwhile forum lawyers, donating their "valuable time", to opine that a mere allegation is a binding and incontrovertible fact (shocked)
plus
a bunch of people screaming "yeah, what they said!  i mean, they're attorneys after all!"
plus
a bunch of other people screaming "yeah, and it's prosper's fault i lent that money!  i want my money back!"
plus
1, from out of nowhere, as if it were magic, payment on the loan

= funny.

I find it interesting that NA loves & defends Prosper at every angle,yet he doesn't lend anymore.

I really hope they wouldn't stoop that low,but to avoid this whole situation,all they have to do is get the borrower to notarize the loan contracts.

Another dagger (an OP payment) showed up today!  I have to say I'm shocked and am hoping the good doctor will continue to pay.  I had the same mindset as beerbud1 ... wondering if the one payment was to make the identity theft argument go away.  Still a ways to go, but a promising sign.

How much was this (and the previous) payment for (compared to a full monthly payment)?  Was it a full monthly payment, or a small payment? 
A normal monthly payment for me started out to be $20.22 (I have $550.00 invested here)
The payment that was made last month was for      $18.92
This month's payment is for the total amount of       $23.02

I can't imagine that the good dr is paying.  I don't know if Prosper is paying or if the wife is paying, but I bet it's one or the other. 

I can call and ask, though.   :ninja:

Yes, please do.  If Prosper is paying, but the payments are showing up as regular payments rather than community payments, that would be yet another outrage.

I left the attorney a message.  He's in Toledo today and tomorrow, but hopefully he'll call me back.
